#AceBreakingNews – New York City police have arrested a man who is suspected of pushing a woman onto the tracks at a Bronx subway station over the weekend: The incident was the latest in a string of violent crimes on one of the world’s largest transit systems.

Police said they had arrested Theodore Ellis, a 30-year-old Bronx resident, after receiving a tip.

The New York Police Department had shared video of the incident showing a man walking up behind a woman, wrapping his arms around her and tossing her over the platform onto the southbound tracks on Sunday afternoon at the Jackson Avenue station.

Local media reported bystanders helped the 52-year-old woman off the tracks before a train arrived and that she suffered a broken collarbone and cuts.

The woman was in hospital in a stable condition, a police spokesperson said.

A $US3,500 ($4,800) reward was offered for information leading to the arrest of the attacker.

Police arrested Mr Ellis on charges of assault and reckless endangerment. Mr Ellis could not be reached for comment, and it was not clear if he had a lawyer.

There are more than 3 million rides taken each weekday on the city’s subway, where serious crime remains rare, although numbers have been on the rise this year.

There were 743 felonies on the subway by the end of April compared to 452 for the same period last year.

Earlier this year, New York Governor Kathy Hochul and Mayor Eric Adams vowed to increase police patrols and expand outreach to people with mental illness after an unusual number of passengers were pushed onto the subway tracks.

In April, a man shot at passengers inside a subway car in Brooklyn, leaving 10 people with bullet wounds.

Frank James was taken into custody some 30 hours later in lower Manhattan and pleaded not guilty to federal terrorism charges.

New York City police have named “a person of interest” after a morning rush-hour shooting at a subway station that left more than 20 people injured.

Police said they were looking for Frank R James, 62, in connection with the attack as he had rented a U-Haul van that may be linked to the shooting. 

The key to the van, rented in Philadelphia, was found at the scene.

“We are looking to determine if he has any connection to the train,” NYPD Chief of Detectives James Essig said. 

The New York Police Department (NYPD) asked “anyone with information on his whereabouts” to call a hotline.

Mr James has not been named as a suspect in the attack. Being identified as a person of interest means police believe he may have information concerning the crime.

The New York Times reports that Mr James, who has addresses in Wisconsin and Philadelphia, appears to have posted dozens of videos on social media in recent years, in which he expresses bigoted views. More recently he had also criticised New York City Mayor Eric Adams.

In a briefing late on Tuesday, police gave more details of the incident which saw a male attacker detonate two smoke grenades and open fire at Brooklyn’s 36th Street station.

The attack unfolded shortly before 08:30 local time (12:30 GMT) on Tuesday, and police said the man had a Glock 9 mm semi-automatic handgun.

“He then fired that weapon at least 33 times, striking 10 people,” police chief Mr Essig said. Seven men and three women were shot.

Images from the scene showed bloodied passengers lying on the floor of the smoke-filled station.

Another 13 people “suffered injuries related to smoke inhalation, falling down or a panic attack”, the police chief said.

All of the victims are expected to survive.

“The male then fled the scene, and detectives are actively trying to determine his whereabouts,” Ms Essig said.

Investigators found the Glock handgun, three extended magazines, a hatchet and a range of potential incendiary devices at the scene. 

A $50,000 (£38,450) reward is being offered for information leading to the arrest of the suspect.

Police say the gunman was roughly 5ft 5in tall and 170lb (77kg). He was said to be wearing a construction vest, grey hooded sweatshirt, and a gas mask.

New York City Police Commissioner Keechant Sewell said earlier on Tuesday that the shooting was not initially being treated as an act of terrorism. 

Witnesses have described hearing people shouting for medical assistance and fleeing in panic. Brooklyn resident Yayha Ibrahim said he saw people running from the 36th Street station.

“I saw a lady, she was shot right in her leg and she was screaming for help,” he told Reuters news agency. Rescue workers “did a good job of coming quick and fast, and the ambulance came in and they took her”, he added.

“My subway door opened into calamity. It was smoke and blood and people screaming,” eyewitness Sam Carcamo told the Associated Press. He added that a billow of smoke poured out of the train once its doors opened.

Initial police investigations into what happened may have been hampered by a failure in the station’s surveillance system.

“At that particular station there appeared to be some form of malfunction with the camera system,” Mayor Adams later said.

Responding to the attack, President Joe Biden expressed gratitude to “all the first responders who jumped into action, including civilians who didn’t hesitate to help their fellow passengers.”

US cities have seen a rise in gun violence over the past two years.

“This insanity that is seizing our city has to stop,” New York Governor Kathy Hochul said after the attack. “We say no more. No more mass shootings. No more disrupting lives.”

Seventeen people have been injured in a shooting during the morning rush hour at a New York City subway station.

The unidentified attacker detonated a smoke bomb and opened fire at Brooklyn’s 36th Street station at 08:30 local time (12:30 GMT).

Images from the scene showed bloodied passengers lying on the floor of the smoke-filled station.

Officials are appealing for information about the gunman, who fled the scene and is still at large.

“An individual donned a gas mask, he then opened fire striking multiple people on the subway and on the platform.” New York City Police Commissioner Keechant Sewell said.

The attacker then fled wearing what Ms Sewell said was a green construction-type vest and a grey sweatshirt.

“This is not being investigated as an act of terrorism at this time,” she added.

Police have since tracked down a rental van they had been searching for in connection with the attack, according to the Associated Press, but the suspect wasn’t there.

Ten of those who are being treated for injuries were shot, while others suffered smoke inhalation as well as injuries sustained during the initial panic. 

Five people are in a critical but stable condition. None of the injured are believed to be in a life-threatening condition, police said.

Officers are still working to establish a motive for the attack.

Another witness, identified only as Claire, told the New York Post that she had “lost count” of the number of shots that were fired. 

The woman said she saw the suspect dropping “some kind of cylinder that sparked at the top” – initially believing him to be a subway worker because of the vest she said he was wearing.

New York’s fire department told the BBC it originally received a call about smoke inside the station.

But officials arrived to find multiple people shot and injured.

Earlier, Depp took a hit in his efforts to hobble his ex-wife’s defense and $100 million countersuit. In a short hearing, Virginia Judge Penney Azcarate ruled against Depp’s summary judgment motion and said Heard can, in fact, utilize the state’s anti-SLAPP statute.

SLAPP is an acronym for a Strategic Lawsuit Against Public Participation. A SLAPP suit is a civil complaint or counterclaim filed against people or organizations who speak out on issues of public interest or concern.

That means that her attorneys can argue Heard is deserving of immunity in front of the jury — and that undercuts a large swath of Depp’s legal strategy.

Depp has previously claimed Heard is “not a victim of domestic abuse, she is a perpetrator,” Depp’s spring 2019 suit even alleged the WaPo op-ed cost him a lucrative role in a potential relaunching of the Piratesfranchise by Disney.

Both Depp and Heard have weathered ups and downs in the matter.

Heard failed in her moves to get the suit moved to California and dismissed, before countersuing Depp in September 2020. After losing his UK libel suit against Rupert Murdoch’s The Sun tabloid in November 2020 after calling him a “wife beater” (an appeal was denied in March 2021), Depp also came up short in January 2021 in his desire to see Heard’s big-bucks countersuit tossed out.

Eve Wilkowitz, 20, was kidnapped and killed leaving a train station in New York in 1980.

Eve Wilkowitz was 20 years old in 1980 when she was kidnapped, raped and strangled to death after she took a train home to Bay Shore, New York, from her secretarial job in Manhattan. Her body was found near her apartment on Long Island.

On Wednesday, Suffolk County police and prosecutors announced the killer was a man who died of cancer in 1991 and who had lived near the spot where Wilkowitz’s body was found three days after she never came home.

Investigators relied on advances in DNA technology to identify the suspect as Herbert Rice, who was 29 at the time.

“We’ve solved the 42 year old homicide case of Eve Wilkowitz,” Suffolk District Attorney Raymond Tierney announced at a news conference. “This was a study in persistence, in determination to work the case no matter what.”

Investigators relied on genetic genealogy, which has been used to help solve a number of cold cases across the country. It enabled police and the FBI to submit the DNA left on Wilkowitz’s body to consumer DNA databases that include countless people outside the criminal justice system.

A match was established through a relative of Rice. Investigators exhumed Rice’s body and compared DNA from his remains to the sample recovered from the initial rape kit, establishing him as the suspect.

Wilkowitz’s sister, Irene, thanked the investigators and recalled, through tears, when detectives knocked at her door with a message: “We’ve identified the person responsible for the death of Eve.”

“She never got to fulfill her dreams,” Irene Wilkowitz said of her sister.

Rice had three convictions for minor crimes that were ineligible for taking a DNA sample at the time.

“These types of investigations are never easy, but the relentless work and partnership helped us bring closure to the Wilkowitz family,” Suffolk Police Commissioner Rodney Harrison said.

#AceBreakingNews – ROCHESTER, N.Y. — New York State Police say a woman was killed before a Rochester Police Officer was found dead in a car at a park.

The following is a summary of events provided by the NY State Police: On March 14, 2022, at approximately 7:53 a.m., the New York State Police were contacted by the City of Rochester Mayor’s Office and the City of Rochester Police Department Chief of Police to investigate a possible homicide in the city of Rochester. Further investigation by the Bureau of Criminal Investigation (BCI) and NYSP Forensic Identification Unit identified the victim as Janet S. Jordan, 35 of Rochester, NY, who was found deceased inside a residence on Wetmore Park. Through the investigative process, Melvin A. Williams, 43 of Henrietta, NY was determined to be a person of interest. Williams was later located deceased in a vehicle at Veterans Memorial Park in Henrietta, NY. Williams was an employee of Rochester Police Department.

The City of Rochester and Rochester Police Department have expressed their appreciation for the assistance of State law enforcement partners.

The State Police Forensic Identification Unit, Rochester Mayor’s Office, Rochester Police Department, Monroe County District Attorney’s Office, Monroe County Sheriff’s Office and the NY Attorney General’s Office are assisting in this investigation.

This is an active criminal investigation.

Further updates will be provided as the investigation continues.

This is an isolated incident. There is no danger to the public at this time.

Many users reported either having trouble registering for an account or were added to a waitlist with a message: “Due to massive demand, we have placed you on our waitlist.”

Former US President Donald Trump’s social media app has launched a year after he was banned from Twitter, Facebook and YouTube, as he seeks a new digital stage to rally his supporters and fight Big Tech limits on speech.

His Truth Social app was offered for download from the Apple App Store to a limited number of subscribers who had pre-ordered.

Others who were added to a waiting list are to be given access over the next 10 days.

The site encountered technical glitches shortly after launch, with reports that subscribers were shut out for hours.

Others had trouble signing on. The site is not expected to be open to anyone who wants to download it until next month.

“Due to massive demand, we have placed you on our waitlist,” read a message to some of those trying to access the platform, adding, “We love you.”

Mr Trump is hoping Truth Social will attract the millions who followed him on Twitter as he hints at a third presidential run, triggering a wave of other subscribers to justify the billions of dollars that investors have bet on the venture.

Shares in a company that plans to buy Trump Media and Technology Group, the parent of Truth Social, have soared in recent months.

According to Apple’s rankings, Truth Social was the top free app in the US on Monday morning, beating the “Talking Ben the Dog” children’s game, streaming service HBO Max, TikTok, YouTube, Instagram and Facebook.

The partial launch Monday follows an experimental “beta” launch to test the platform last week.

A launch with little fanfare

Mr Trump was banned from top social media platforms after the January 6 Capitol riot last year that critics accused him of inciting.

The ban has raised difficult questions about free speech in a social media industry dominated by a few tech giants — an issue that Trump and conservative media have seized upon.

Republicans were quick to use the launch of Truth Social to raise money for their election efforts.

“After over A YEAR of muzzling by the Liberal Big Tech Tyrants: TRUMP. IS. BACK,” wrote GOP House Minority Leader Kevin McCarthy in a fundraising email appeal Monday.

Groups like the Republican National Committee and the Congressional Leadership Fund also have been fundraising off the launch.

“Our main goal here is to give people their voice back,” Trump Media CEO and former GOP Congressman Devin Nunes said on Sunday on Fox News.

He added that the app offers “the opposite of some Silicon Valley tech oligarch freak telling people what they want to think and deciding who can or cannot be on the platform.”

Mr Nunes said the app should be “fully operational” by the end of March.

For all the fanfare, Mr Trump appears to have largely stayed away from the app on launch day.

A screenshot taken of his Truth Social account showed no new messages as of 4pm EST.

His last message was from a week earlier: “Get Ready! Your favourite President will see you soon!”

Before Twitter permanently barred him from posting last year, Mr Trump had tweeted nearly 60,000 times and had attracted almost 90 million followers.

His Truth Social followers on Monday were listed at 12,000.

Challenges on the horizon

Mr Trump is hoping to tap into outrage over the social media bans to attract a broad audience to keep the stock rising — and possibly hand him hundreds of millions of dollars personally — but he faces significant challenges.

None of alternative messaging platforms already open to public, such as Gettr and Parler, have been able to move beyond an echo chamber of conservative political commentary.

Mr Trump’s company, Trump Media, also faces financial hurdles.

It has been promised nearly $300 million from a publicly traded company that plans to merge with it and got pledges from dozens of private investors for an additional $1 billion to fund its operations, but it still needs approval from regulators for the deal before it can access the cash.

The company it hopes to merge with, Digital World Acquisition Corporation, has said regulators are investigating after reports that it may have broken security rules last year by talking to Trump representatives about possibly joining forces before selling stock to the public.

Digital World is a so-called blank-check company that is only allowed a quick path to going public without many disclosures if it has not identified a target to buy yet.

Another regulatory investigation is focused on possible stock trading violations earlier in the fall.

Investors in shares of Digital World are valuing its eventual merger target, Trump Media, at $10 billion.

Prince & Giuffre: He made no admission of liability denied the allegations

The Duke of York agreed to pay an undisclosed sum as part of the settlement, and accepted Ms Giuffre had suffered as a victim of abuse: Speaking to the BBC’s Americast podcast, New York lawyer Randy Zelin said of the settlement: “Both sides gave a little something up, both sides can hold their heads up high”.

American lawyer Lisa Bloom said it was a huge victory for Ms Giuffre. 

“This is a monumental win for Virginia,” said Ms Bloom, who represents several of sex offender Jeffrey Epstein’s victims – adding that it was a win “for everyday people… standing up against the rich and powerful”. 

Ms Giuffre had been suing the Duke of York, claiming he sexually assaulted her on three occasions when she was 17 – which Prince Andrew has repeatedly denied.

On Tuesday it was announced they had reached an out-of-court settlement.

A statement from their lawyers said the duke would pay an undisclosed sum to Ms Giuffre and make a “substantial donation” to Ms Giuffre’s charity in support of victims’ rights.

It also said the duke regretted his association with Epstein. Prince Andrew had previously told BBC Newsnight in 2019 he did not regret being friends with Epstein.

But no details of the payout to Ms Giuffre have been made public – and there are calls for more detail about where the money will be coming from. 

Although the exact amount of the financial settlement has not been revealed, reports have speculated that it could run into millions of pounds. The duke receives a Royal Navy pension and a stipend from the Queen’s Duchy of Lancaster income.

Kate Macnab, a lawyer at Reeds Solicitors, said: “It is likely there will be some demands to know where the payment is coming from – public or private purse?”

And Graham Smith from the anti-monarchy group Republic said taxpayers deserved to know where the money for the settlement was coming from.

Speaking to BBC Breakfast, Gloria Allred, a US attorney who has represented a number of Epstein’s victims, said the statement confirming the settlement was “vague” and would have been “carefully negotiated”. 

“It’s clear that the prince is not saying that he admits that he did anything wrong,” she said.

“He does say that she has suffered as a victim of abuse. He doesn’t say abuse by whom, he doesn’t say sexual abuse, he doesn’t say that he had anything to do with her.”

Ms Allred said the “war between the two parties… will now end”, but added it remained possible that Ms Giuffre could testify in future court cases. 

“No settlement such as this one can ever require that an accuser remain silent in the criminal justice system,” she said. 

“A prosecutor could decide to file criminal charges, in which case, Virginia could testify if called on.”

Also speaking to BBC Breakfast, Liz Stein, one of Epstein’s accusers, said the settlement had come as a shock, but taking the case to trial would have been “incredibly difficult” for Ms Giuffre. 

“I think that what Virginia wanted more than anything else was validation and I think that in the settlement she got that,” she said. 

“Whatever he lost as a result of this could never compare to what the victims of Epstein, Maxwell, and the men that we were trafficked to have lost from our lives.”

In the statement on Tuesday, Prince Andrew pledged to support “the fight against the evils of sex trafficking, and by supporting its victims”.

Speaking to BBC Newsnight, Ms Bloom said: “I am sure that his money would be welcomed in organisations that are struggling to help victims everyday. 

“In terms of his personal participation, probably not.”

Former Royal Navy officer Rear Adm Chris Parry, who was Prince Andrew’s flight commander, added: “I think really he should look to a private life and enjoy essentially what is a very good privileged lifestyle. But I think he should stay out of the public eye.”

Is there any way back for Prince Andrew?

If Prince Andrew had gone to court in the US to fight it out with Virginia Giuffre, it would have made headlines as tall as a New York skyscraper.

That royal disaster zone has been averted by an out-of-court settlement.

But it comes with high costs to Prince Andrew, both financial and reputational, and it will be a long road back before there is any chance of clearing his name in terms of public opinion.

Following the settlement, Labour MP Rachael Maskell, whose constituency is in York, renewed calls for Prince Andrew to give up his association with the city. 

She said doing so would demonstrate respect for “those affected by abuse and the people of our city”.

Ms Giuffre, now 38, claims she was the victim of sex trafficking and abuse by financier Epstein from the age of 16. Epstein died while awaiting trial in 2019. 

She claimed the duke sexually assaulted her on three separate occasions in London, New York, and on Epstein’s private island in the US Virgin Islands.

In a 2019 interview with BBC Newsnight, Prince Andrew said he didn’t recall meeting Ms Giuffre and that an incident in which they had sex at the Belgravia home of Ghislaine Maxwell “didn’t happen”.

In January, a New York court ruled that the civil action against him could go ahead.

Shortly afterwards, Buckingham Palace said the prince’s military titles and royal patronages had been returned to the Queen and that he would defend Ms Giuffre’s civil case as a “private citizen”.

Speaking to the BBC’s Americast podcast, New York lawyer Randy Zelin said of the settlement: “Both sides gave a little something up, both sides can hold their heads up high”.

Speaking in support of the duke, British socialite Lady Victoria Hervey said she hopes the Royal Family could now focus on the upcoming jubilee celebrations, and that “Prince Andrew can put these false allegations behind him”.

The settlement, including an undisclosed payment, was revealed in the joint filing in Manhattan federal court, where Giuffre had sued Queen Elizabeth’s second son last August.

It spares Andrew from a potentially embarrassing series of disclosures and accusations in the months leading up to and during a trial, which was slated to begin late this year.

Andrew, 61, has denied Giuffre’s accusations that he forced her to have sex more than two decades ago at a London home of former Epstein associate Ghislaine Maxwell, and abused her at two Epstein properties. Giuffre, 38, has been one of Epstein’s and Maxwell’s most prominent accusers.

Lawyers for Giuffre and Andrew said the prince intends to make a substantial donation to Giuffre’s charity in support of victims’ rights.

The prince “never intended to malign Ms. Giuffre’s character, and he accepts that she has suffered both as an established victim of abuse and as a result of unfair public attacks,” the filing said.

“Prince Andrew regrets his association with Epstein, and commends the bravery of Ms. Giuffre and other survivors in standing up for themselves and others,” the filing added. “He pledges to demonstrate his regret for his association with Epstein by supporting the fight against the evils of sex trafficking, and by supporting its victims.”

The statement is a marked departure from an interview that Andrew gave the BBC in 2019 in which he failed to appear sympathetic toward Epstein’s abuse victims, and refused to apologize for his friendship with Epstein.

The Royal Family last month removed Prince Andrew’s military links and royal patronages and said he will no longer be known as “His Royal Highness.”

Andrew was defending against GIuffre’s lawsuit as a private citizen.

Buckingham Palace declined to comment. A spokeswoman for the prince declined to comment beyond the court filing.

Epstein killed himself at age 66 in a Manhattan jail cell in August 2019 while awaiting trial on sex trafficking charges.

Last month, U.S. District Judge Lewis Kaplan rejected Andrew’s bid to dismiss Giuffre’s lawsuit, which accused him of battering Giuffre and intentionally causing her emotional distress.

He also said it was premature to decide whether Giuffre’s 2009 civil settlement with Epstein also shielded Andrew.

#AceHistoryReport – On February 13, 1914, the American Society of Composers, Authors, and Publishers (ASCAP) was founded in New York City. The purpose of this organization was–and remains–to protect the copyright and performance rights of the works of its members: composers, songwriters, lyricists, and music publishers.

#AceHistoryDesk says ASCAP: Was Founded On February 13: 1914: ASCAP’s first director was composer and musician Victor Herbert, an eloquent supporter of musicians’ rights to receive royalties for the use of their work.

Herbert’s testimony had an impact on the passage of the 1909 Copyright Law of the United States (PDF), that extended composers’ rights to include royalties for the sale of recorded music.

According to the story told about the birth of the society, the popular composer Victor Herbert became aware of the need for protection of musical creators’ rights when he was visiting a hotel and overheard a musician playing a piece of music that he had written. He knew that he had not been paid for the use of his music in performance, even though copyright law had protected against the unauthorized public performance of music since 1897. From that time, Herbert worked hard to organize creative artists into a collective and to bring the problem of payment of royalties to the attention of policymakers.

Herbert served as director and vice president of ASCAP until his death in 1924. Some other members of ASCAP represented in the Library’s collections include W.C. Handy, Irving Berlin, George M. Italian-American Mario Olmeda shared his passion for traditional Italian singing with folk music collector Sidney Robertson Cowell on February 13, 1939, in Concord, California. Cowell recorded Olmeda’s rendition of six Italian folksongs, including “Marinaro (The Sailor),” and “La Capinera(The Blackbird),” a song that he said he had learned from his father. The judge said it was premature to consider Prince Andrew’s efforts to “cast doubt” on those claims, though the 61-year-old royal could do so at a trial.

Lawyers for the Duke of York and Ms Giuffre did not immediately respond to requests for comment.

The decision keeps Ms Giuffre’s case against Prince Andrew on track for a trial that Judge Kaplan has said could begin late this year.

While the claims have not been proven and the Prince is not accused of criminal wrongdoing, his ties to Epstein have damaged his reputation and cost him many royal duties.

A spokesman for Buckingham Palace declined to comment on Judge Kaplan’s decision.

Prince Andrew has denied Ms Giuffre’s accusations that he forced her to have sex more than two decades ago at a London home of former Epstein associate Ghislaine Maxwell, and abused her at Epstein’s properties in Manhattan and the British Virgin Islands.

Lawsuit allowed to continue

In his 44-page decision, Judge Kaplan said the “muddled” language in Ms Giuffre’s and Epstein’s 2009 settlement agreement suggested that they may have arrived at “something of a middle ground” on whether to shield the Prince or others from future lawsuits.

“We do not know what, if anything, went through the parties’ minds,” Judge Kaplan wrote.

“The parties have articulated at least two reasonable interpretations of the critical language. The agreement therefore is ambiguous.”

Settlement agreements can restrict plaintiffs like Ms Giuffre from pursuing further litigation, even against third parties.

Ms Giuffre was awarded $500,000 in the 2009 settlement.

Judge Kaplan also rejected Prince Andrew’s claim that letting Ms Giuffre sue violated his due process rights under New York’s constitution.

Ms Giuffre had sued the Prince in August, less than a week before the expiration of a state law giving accusers a two-year window to bring claims over alleged child abuse occurring long ago.

Judge Kaplan called that window, which was extended by a year because of the COVID-19 pandemic, “a reasonable measure for remedying injustice to victims” of child sex abuse.
