In a December submission, Human Rights Watch urged the Australian government to use the dialogue to press Vietnam to end its systematic suppression of fundamental civil and political rights, including freedom of expression, association, peaceful assembly, and religion and belief. Australia should also demand that Vietnam immediately release all political prisoners and detainees, and revise its problematic penal and criminal procedure codes to bring them into line with international human rights standards.

An Australian citizen, Chau Van Kham, has remained in a Vietnamese prison since January 2019 on terrorism charges for his involvement in Viet Tan, a peaceful political organization focused on democracy and human rights in Vietnam. Securing his release, and enabling him to return to Australia to be reunited with his family, should be a top priority for Australia in the dialogue.

As of December, Human Rights Watch had documented that at least 146 people are behind bars in Vietnam for exercising their basic rights, including the prominent bloggers and activists Tran Huynh Duy ThucPham Chi DungNguyen Tuong ThuyPham Chi ThanhCan Thi TheuLe Dinh LuongTruong Minh DucNguyen Trung TonPham Van TroiHoang Duc BinhTran Anh KimPham Van DiepTran Duc ThachNguyen Trung Truc, and Ho Duc Hoa. The police have arrested at least 30 other people on politically motivated charges, including the influential blogger Pham Doan Trang, and the land rights activists Trinh Ba Phuong and Nguyen Thi Tam.

Australia’s bilateral relationship with Vietnam has continued to grow in recent years. In 2021 Australia was one of the top 10 trade partners with Vietnam. In November, the Australian Foreign Affairs Minister Marise Payne visited Hanoi, but she did not raise human rights concerns publicly during her visit.

#AceDailyNews says according to BBC Canada News Report: Trudeau Challenges compensation order for indigenous children: Last month, a top court upheld a 2016 ruling that the government underfunded First Nations services compared with those for non-indigenous children: It ordered C$40,000 ($31,350; £23,340) payouts to each child who was in the on-reserve welfare system after 2006.

Ministers and officials said in a statement on Friday that they had filed a “protective appeal” as a deadline loomed, but would pause litigation until all parties meet before December. The statement added that they will seek to settle the matter outside of court.

“I despise the imagery, but we’re putting our swords down,” Minister of Crown-Indigenous Relations Marc Miller told reporters in a Friday evening news conference. 

Campaigners had called for the government of Prime Minister Justin Trudeau not to appeal against the ruling.

Cindy Blackstock from the First Nations Child and Family Caring Society told CBC News: “If there is no deal, we’re going to go to hearings on an expedited basis. We don’t want children to lose out on this time.”

In 2016, the Canadian Human Rights Tribunal ruled that the government had underfunded First Nations children’s services compared with those for non-indigenous children.

The government appealed against that ruling in 2019, but lost its challenge last month in the federal court. 

Mr Trudeau, who won re-election last month, came into office in 2015 promising to strengthen and restore ties with native communities.

Speaking from the Netherlands ahead of international summits in Rome and Glasgow, he told reporters: “We are committed to compensating indigenous people who were harmed as children in child and family services.”

THE WORDS ARE NOT MINE – I PROBABLY COULDN’T HAVE PUT IT THIS WELL.

This is an open letter to Australian politicians who have allowed our country to become a place I no longer recognise. But you have lost my consent. In fact, I don’t remember you ever asking.

So let me be clear. You DO NOT have my consent to crush our way of life. To criminalise me for going further than 5 kilometres from my home. To set up police checkpoints on our roads – roads that I paid for, when I used to be allowed to work, when I used to be allowed to leave my home without explaining myself to someone in uniform.

You DO NOT have my consent to keep me from my family. To tell me “we are all in this together” while forcing us to stay apart. To lecture me about the morality of seeing people I love or checking in on a neighbour I pass at the shops. To make me “register” to see a friend. What sort of nightmare are you creating?

Who are you to tell me it is “good” to obey you, and “bad” to defy you? To come onto my screen daily and lecture me on my “behaviour”. To position a police officer behind you every time you speak. To hide behind public health officials. To threaten me with jail if I don’t listen. To fly police helicopters over my neighbourhood. To put the “riot” squad and the military on our streets (for our own good, of course). Who are you to decide what is “good” and “bad”, and to enforce your new world order with weapons?

The only type of “bad” I recognise is the powerful forcing the weak to do something against their will.

You DO NOT have my consent to confiscate my right to protest. To paint those who make their voices heard as bad people. To pretend they punch horses. To use the dark tools of propaganda. To tell us they are criminals. What are you really scared of?

This is a hostage situation, dressed in the language of public health. You have created a nasty police state, a dystopian nightmare, an ex-democracy, a petty dictatorship. You are frightened of your own people, and you don’t want them to be heard. You need the media to serve up its daily offering of fear porn. Who knew that you guys would work so well together?

None of you have lost a dollar, of course. None of you have volunteered to stop drawing a salary, to accept $320 disaster payment instead of making a living. You are the worst type of hypocrites, lecturing on the morality of a pain you do not share.

And now you encourage us to call the police on each other? To be a nation of dobbers. To distrust our neighbours. How deep are the scars you are creating?

You DO NOT have my consent to trap me in this country. To make me seek an “exemption” to leave. To decide where I must live my life. Is there any clearer sign that you have lost the consent of the governed than to force them to stay?

How dare you masquerade as our saviours. Our behavioural masters. Our moral enforcers. Our life extenders. I do not want your “protection”.

You have forgotten what you are. ‘Public servants’. Think about those words. Don’t twist them. Why don’t you let us be the judge of our own safety? Let those who wish to hide, hide? How dare you make these decisions on my behalf. You are destroying our lives in order to save them.

You are no longer ‘public servants’. Instead, you demand the public’s obedience down the barrel of a gun. How have you become convinced that using force to prevent people from moving freely is anything other than criminal?

You are destroying everything I love about this country: our bravery in the face of danger, solidarity between neighbours, the strength to muddle on, the freedom to come and go as we please.

Let’s be clear: there are many who despise you. These are the ones you are trying to silence. These are the ones you are afraid of. They are growing in number and they are enraged by your conduct.

You will never have our trust again. We don’t propose to “put all this behind us” when the pandemic is eventually over. You have broken something beautiful, and it will stay broken long after this is gone.

(ARMENIA) Human Rights Report: Authorities have persisted with spurious criminal incitement charges against a human rights activist, Sashik Sultanyan, HRW said today #AceNewsDesk report

“Although Armenian authorities might disagree with the content of Sultanyan’s interview, the opinions he expressed in it fall squarely within the boundaries of legitimate speech, protected under international law,” said Giorgi Gogia, associate Europe and Central Asia director at Human Rights Watch. “The authorities should immediately drop the charges against Sultanyan and ensure that there is no undue interference in his legitimate human rights work.”

Sultanyan is the chairperson of a nongovernmental group, Yezidi Center for Human Rights, which since 2018 has worked on community mobilization, awareness raising, and anti-corruption issues in Armenia.

On October 3, 2020, Armenia’s National Security Service (NSS) initiated a criminal investigation against Sultanyan, stemming from an interview he gave to the website Yezidinews.am that was published in June 2020. In the charge sheet, which Human Rights Watch reviewed, the investigator refers to several of Sultanyan’s statements to justify the criminal investigation into inciting national enmity among Yezidis, a national and ethnic minority in Armenia.

The investigator referred to Sultanyan’s interview statements alleging, among other things, that Yezidis experience discrimination in Armenia, that they cannot study their language or develop their culture, and that they are underrepresented in local government structures. The investigator also referenced Sultanyan’s allegations that Armenians had seized Yezidi property, that authorities do not protect their rights, and that Yezidis live “in fear.”

The investigation appears to have been opened based on a complaint filed by a leader of the Veto Movement, a radical group that has built a reputation for aggressive hostility against human rights defenders in Armenia.

The criminal case also is flawed procedurally, Human Rights Watch said: Although the investigation was opened in October 2020, the authorities provided information to Sultanyan about it only in May 2021. In a response dated November 21, 2020, to an official request for information, the NSS confirmed to Sultanyan that there was a criminal investigation underway but did not provide him with any further information or a copy of the decision to open the investigation. The NSS informed Sultanyan that he had no procedural status in the investigation and thus could not demand access to further information about the case. The refusal to share information with Sultanyan even when he was a subject of investigation undermines Sultanyan’s rights to a fair process and an effective remedy protected under articles 6 and 13 of the European Convention on Human Rights.

On June 2, 2021: Human Rights Watch wrote to the prosecutor’s office, urging it to drop charges against Sultanyan and ensure that he is able to do his legitimate human rights work without undue interference. In its June 10 response, the prosecutor’s office stated that the investigation had been opened “according to national and international norms,” and that the circumstances cannot be interpreted as violations of Sultanyan’s rights.

The authorities have wrongly characterised Sultanyan’s statements as “incitement,” Human Rights Watch said: They fall within the boundaries of legitimate speech protected under international law, in particular article 10 of the European Convention on Human Rights and article 19 of the International Covenant on Civil and Political Rights. As a party to both treaties, the Armenian government has specific legal obligations to protect freedom of speech:

“ Armenian authorities are violating Sultanyan’s right to his freedom of expression,” Gogia said. “While fighting national and ethnic hatred is the government’s responsibility, it’s not achieved through criminalizing legitimate speech or otherwise violating the rights of those who speak out on sensitive matters.”
